摘要
随着我国高等教育体制改革的不断推进,高等学校与教师的法律关系发生了很大变化,由过去的任命制转换为现在的聘任与被聘任关系,这是一种新型的教育法律关系,具有法定性、管理性、平等性、自主性和程序性等特征。针对高校教师聘任中存在的问题,当前应加强教育立法,使高校教师聘任工作制度化、规范化,加快教师任用制度改革步伐,使高等学校教师任用工作全面纳入法制化轨道。
With the development of system reform in higher education, great change happens in the relationship between colleges and teachers. Administrative appointment has transformed into both-side contract. It is a new-type educational legal relationship, characterized by legality, management, equality, independence and procedure etc. In the light of the problem in contract with teachers, much work should be done in the reinforcement of educational legislation, to make it standardized,to fasten the reform in contract with teachers, and to make it a mature legal system.
