Social Governance through Pressure-Type Justice:Interpreting the Houjie Bankruptcy Dispute in Extended Case Method

运用延伸个案方法,本文'深描'一起企业破产纠纷的缘起、发展、解决及其影响,以此探讨压力型司法。从压力型体制脉络出发,'压力型司法'旨在阐述司法活动的发生场域,即以'指标(指令)一考核'为基本手段的权力关系网络,且这种支配关系不仅充斥于整个司法活动,还弥漫至司法人员、司法体制、司法实践与党政力量、社会治理的相互关系之中。除了压力型司法的结构、运行及功能,该场域还涉及这套权力关系网络在社会治理中的投效以及行动者对该种投效的种种反应。本文侧重考察压力型司法体制的溢出效应,即对个案、当事人、社会治理的细微、隐秘影响,以及这些互动对于压力型司法的反作用。压力型司法在社会治理中的投效以及行动者的种种反应表明,应当在客观对待'个案解决'的基础上对'总体性失范'保持警惕。

In order to study the pressure-type justice,this article employs the extended case method to'thickly describe'the origin,development,resolution and impacts of a corporate bankruptcy case.Starting from the context of pressure-type system,'pressure-type justice'aims to describe the field of occurrence of judicial activities,which is the network of power relations with'indicators(instructions)-assessment'as the core means,and this dominance is not only full of justice activities,also permeates the interrelationship between judicial personnel,judicial system,judicial practice,party and government forces,and social governance.In addition to structure,operation,and function of pressure-type justice,the field also involves the effectiveness of this network of power relations in social governance and the actors’responses.Especially,this paper focuses on the spillover effects of the pressure-type judicial system,namely,the subtle,hidden influences on cases,parties,social governance,and the counteraction of these interactions to pressure-type justice.The effectiveness of pressure-type justice in social governance and actors’responses indicate that it is necessary for us to be vigilant against'general anomie'on judging'solving dispute'objectively.
