摘要
网约车是"互联网+"的产物,是对传统出租车的挑战,是出租车服务的新模式、新业态。市场准入问题是网约车监管的关键。通过对网约车市场准入制度的实证分析发现,目前,我国网约车市场准入制度存在的主要问题有国家立法尚不健全、各地市场准入标准不一、传统出租车特许经营市场准入制度面临严峻挑战等。应当建立健全网约车市场准入制度、明确网约车市场准入条件和标准、明晰各方主体的权利和义务,进而有序推进传统出租车市场管理制度改革,逐步实现传统出租车与网约车市场准入并轨。
Online car-hailing is the product of'Internet+',it is a new mode and new business mode of taxi service,and has been a challenge to the traditional taxi.Market access is the key to deal with the regulation of online car-hailing.Through the empirical analysis of the online car-hailing market access system,China’s online car-hailing market access system has some problems,such as National legislation is not yet sound,different market access standards at the local level,and conflict with the traditional taxi franchise market access system.By establishing the online car-hailing market access registration system,setting unified conditions and standards for online car-hailing market access,and clarifying the rights and obligations of all parties involved in online car-hailing,then,the reform of the management system of the traditional taxi market will be advanced in an orderly way,and the integration of the traditional taxi and the online ride-hailing market will be realized step by step.
