摘要
修改后的《行政诉讼法》及其司法解释对行政规范性文件的附带审查范围,并没有作出十分清晰的规定,给理论与实践留下了较大的争论空间。基于行政规范性文件司法审查的必要性,从现有文本规定出发,着眼于行政诉讼全面审查原则的彻底贯彻、行政诉讼效率的提高、行政效率的提高、维护相对人合法权益等多维视角的审视,确立行政诉讼中行政规范性文件的全面审查原则,不仅能充分发挥行政诉讼的监督功效,更有利于促进对行政规范性文件的源头治理,进而从源头上解决依法行政中的问题。
The revised Administrative Litigation Law and its judicial interpretation have not made a very clear provision on the scope of incidental review of administrative normative documents,leaving much room for debate in theory and practice.We should base on the necessity of judicial review of administrative normative documents,start from the existing text provisions,focus on the thorough implementation of the principle of comprehensive review of administrative litigation,the improvement of administrative litigation efficiency,the improvement of administrative efficiency,the protection of the legitimate rights and interests of the relative person and other multi-dimensional perspectives,and establish the principle of comprehensive review of administrative normative documents in administrative litigation.It can not only give full play to the supervisory effect of administrative litigation,but also promote the management of the source of administrative normative documents,and then solve the problems in administration according to law from the source.
