政府购买公共服务的主体结构及其程序构造之展开

On the Subject Structure and Procedure Constructive Development of Government Purchase Public Service

政府购买公共服务是合作治理背景下政府履职方式上的一种创新,从法律关系基本构造上看,政府从直接提供公共服务转向外部购买公共服务是由二元主体结构迈向三元主体结构的演绎过程。供应商的加入打破了原有的二元主体结构及其程序,而程序构造也因此在程序理念、价值、范畴与内容上发生着流变,并决定着政府购买公共服务程序构造从修补、调整与创设三个维度上展开。据此,未来我国政府购买公共服务程序的建构,应立足在三元主体结构上,将购买程序划定为四个基本环节,并在各环节中依次建构或完善相关程序制度,从而保障政府与供应商合作共赢。

Government purchase public service is an innovation in government performance under the background of cooperative governance.From the basic construction of administrative legal relationship,the transformation of the government from providing public services directly to purchasing it externally is the deductive process from the binary subject structure to the ternary subject structure.The participation of the manufacturer has broken the original binary subject structure and its procedure,and procedure constructive also develops in its concept,value,category and content.It is determined that the procedure construction of government purchasing public service should be carried out from the three dimensions of repairing,adjusting and creating.Therefore,the construction of government purchase public service procedures in the future should be based on the ternary subject structure,classified the purchase procedure into four basic links,and in each link constructed or perfected procedure legal system successively,guaranteed the win-win cooperation between the government and the manufacturer.
