Innovation on Idea and Mechanism of Rural Good Governance under Changes of Land Rights

城乡统筹背景下农村土地制度变革与乡村治理之间存在紧密的互动关系。乡村治理的关键在于价值理念的选择,应当坚持善治基本理念,追求统筹发展理念下的一体化发展,以人为本理念下的主体性和参与公平法治理念下的和谐性构建。城乡统筹进程中乡镇、村集体、农户和企业在农村土地上的权利和利益是动态性的,这些权利主体之间的相互关系与乡村治理密切关联,应当符合乡村善治的要求。我国乡村治理应当适应多中心参与的趋势,充分发挥不同治理主体的功能,构建自主性的民主自治机制、信任性的经营合作机制和充分性的纠纷协调机制。乡村治理应当以善治理念统帅,与城乡统筹的土地制度创新相协同,以土地有效利用与权利保护为基点,构建多中心参与的多元化的乡村治理机制。

It has an interactive relationship between rural land reform and rural governance in the coordinated designs of cities and countryside. The rural governance lies in the choice of values,and it should adhere to the basic concept of good governance, and seek the integrated development of coordinating development,subjectivity and participation under the fair rule of law,and harmony under the people-oriented idea. The rural land right and benefit of township,village collective,farmers and enterprises in the process of urban and rural areas is dynamic,which is closely related with rural governance,and it should conform to the requirements of the rural good governance. Rural governance in China should adapt to the trend of multi-center participation, give full play to the functions of the different governance body,and build autonomy of democratic self-government mechanism, the trust business cooperation mechanisms and the adequacy of disputes coordination mechanism. The rural governance should be based on the good governance,cooperate with the land system innovation,insist on the effective use of land and the right protection in various organizations and institutions as a platform,in order to build a diversified rural governance mechanism as multi-center to participate.
