公平竞争审查制度的语言学进路

语言分析方法是社会研究中不能忽视的一种方法,对公平竞争审查制度进行语言学分析,具有重大的理论和实践意义。公平竞争审查制度是一个具有中国特色的称谓,从语言表达上来看,"竞争"与"审查"实现了目的与手段的结合,"公平"与"竞争"实现了形式与实质的统一。"竞争"本身就含有公平竞争的意思,在此之前又加上"公平"二字,更突出了公平的竞争理念和特定的汉语环境。然而,刻意追求"公平",会产生"公平"掩盖"竞争"的不良后果;过度考虑"公平"的汉语环境,将导致国际通行标准的"走样"。从语言学的视角推进公平竞争审查制度,竞争主管部门及相关机构就要培育竞争文化,不断促进与公众的交流互动,倡导竞争,促进竞争完善信息协同,加强法律保障。

The linguistic analysis method is a method that cannot be ignored in social studies.The linguistic analysis of fair competition review system has great theoretical and practical significance.From the perspective of language expression,“competition”and“review”achieve the combination of purpose and means.“Fairness”and“competition”achieve the unity of form and substance.The fair competition review system is a title with Chinese characteristics.“Competition”itself implies the meaning of fair competition.Prior to this,the word“fairness”was added to give more prominence to the concept of fair competition and the specific Chinese environment.However,deliberately pursuing“fairness”will have the negative consequences of“fairness”over“competition”.Excessive consideration of the“fair”Chinese language environment will lead to the“outliers”of international standards.From the perspective of linguistics,the fair competition review system should be promoted.Competition authorities and other relevant agencies must do a good job in promoting competition and foster a culture of competition in order to continuously promote exchanges and interactions with the public,conduct competition advocacy,improve information collaboration,and strengthen law’s protection and other measures.
