Compulsory Transfer of Share Rights

股权因法院的强制执行而转让的问题 ,是我国立法中的一个空白。 1 998年 6月最高人民法院《关于人民法院执行工作若干问题的规定 (试行 )》中首次对这一问题作出规定。

There had been no provision on the transfer of share rights caused by enforcing court judgments in the legislation of our country.The 1998 ″Tentative Provisions on Certain Problems of the Enforcement by the People's Court″ started dealing with related problems.This article puts forward proposals,through an analysis on the judicial interpretation,for the perfection of our legal regime of compulsory transfer of share rights.
