摘要
法律行为内容合法是法律行为有效成立的要件之一 ,但其适用却是异常复杂的 ,对其作深入的研究是完全必要的。正确地界定不得违反法律的法律范围至关重要 ;该要件是一项效力性规范 ,其功能表现在对私法自治的内容限制 ,以及提供了一条使公法规范进入私法领域的管道 ;通过对具体强行法规范目的的解释来决定法律行为的效力是理解和适用该要件的关键。
Legitimate content is one of the requirements of valid jurist act.Due to its intricate application, it is necessary to make a study of it.First of all,we should define the range of infringing the regulations of law' precisely,for the requirement is a regulation concerning validity and its functions are to limit the autonomy of the civil law and to provide a way how the regulations of public law can interfere with the civil law.The key issue of how to apprehend and apply the requirement is to determine the validity jurist act by explaining the concretely compulsory regulations for the purpose.
