试析现行知识产权制度对我国中药的保护

A Tentative Analysis of Protection by System of Standing IntellectualProperty Right of Traditional Chinese Medicine in China

中药现代化是将传统中医药的优势、特色与现代科学技术相结合,开发现代中药,创立研发体系和标准规范,以适应当代社会发展需求的过程。这个过程需要有知识产权保护的,然而现行知识产权制度对中药知识产权保护存在不足。因此,在中药现代化研究过程中应重视和积极利用知识产权制度,扬长避短,及时将创新研究成果形成知识产权。

The modernization of traditional Chinese medicine is a process in which the advantages and features of traditional Chinese medical science and traditional Chinese medicine should be integrated with modern science and technology to develop modern Chinese medicines and create the system of their research and development as well as their criteria and standards in order to adapt the demand of the current social development. This process asks for the protection of intellectual property right. Nevertheless the system of the standing intellectual property right falls deficient in the protection of TCM intellectual property right. Therefore, the system of intellectual property right should be given great attention and be actively applied, making best use of its advantages and bypassing its disadvantages, so as to turn the results of innovative studies into intellectual property right in time.
