法经济学的效益目标

Benefit goal of economic analysis of law

法经济学以效益作为首要价值目标,这是符合现今经济基础发展需要的。法经济学把效益目标放在首位,并不意味着放弃法的公正目标,而是为了实现及时的、广泛的公正。但以效益作为首要目标并不适合于所有的法律制度,其最佳的适用领域局限在部分财产法中。实现法的效益目标的方法包括机会成本比较、边际分析、均衡分析等。

The economics of the law looks on benefit as the primary goal of value. It accords with the demand ot eco-monic development nowadays. But it does not mean that economics of the law give up the justice. On the contrary, what the economics of the law engage in is the justice of more prompt and more comprehensive. The methods that fulfil the goal of profits include opportunity cost contrast, equilibrium analysis,marginal analysis, and so on.
