当代中国死刑民意的状况、成因及其变革路径

The Situation of the Public Opinion of Death Penalty in China and its Cause and Reform Measures

当代中国,绝大多数民众反对废除死刑,限制死刑也无法得到广泛支持,崇尚死刑还比较普遍。其主要成因在于死刑报应观念、威慑观念在社会大众中广泛存在。在死刑观民意的变革中,要以社会各阶层的合力推动、引导民意向着人道、宽容的理念发展。其中,学者应当负起启蒙的责任,政治决策层应承担起引导的义务,立法、司法机关应当以减少死刑立法和死刑适用的方式促进民意进步,而新闻媒体则应当坚持正确的舆论导向,减少死刑观念变革的负面影响。

In modern China,above ninety percent people resist the abolishment of death penalty,the limitation of death penalty is not popular,even some think highly of death penalty.The basis of public opinion is the viewpoints of revenge and deterrent which is also the main value choice of the public to death penalty.We should guide the public opinion to the direction of humanity and tolerance with all strength of the society.Among which,scholars should assume the responsibility of enlightening,statesmen should assume the responsibility of guidance, legislative and judicial organs should assume the responsibility of reducing the legislation and application of death penalty in order to impel the transform of public opinion,and to the media,they should insist the proper guidance of media and reduce the negative impact of the reform.
