On Legislating the Chinese Anti-circumvention Law After China's Entering WTO

本文在分析WTO《关于反规避的决定》的涵义与意义的基础上 ,联系GATT《邓克尔草案》中的反规避条款和欧美反规避立法的最新发展 ,结合我国实际系统阐明了加入WTO后构建我国反规避立法的必要性 。

On the basis of analyzing the connotations and meanings of WTO's Decisions on Anti-circumvention, this paper,relating the anti-circumvention regulations of GATT's Dunkel Text and the latest development of the anti-circumvention legislation in Europe and America, and combining China's reality to illustrate systematically the necessity of legislating the Chinese anti-circumvention law after China's entering WTO, puts forward some suggestions and countermeasures to perfect China's legislation of anti-circumvention.
