交通行政执法模式改革的依据、目标与原则

Research on Foundation, Target and Principle in Reformation of Model for Law-Enforcement in Traffic Administration

针对现行交通行政执法模式的改革问题 ,从理论、国外经验、现实需要、基本法律和基本政策导向等方面作了深入分析 ,得出了改革现行模式是非常必要、切实可行且依据充分的结论 ,并据此导出了改革目标和原则 ,为构建新模式奠定了基础。提出了“行政权力制衡与行政保障相结合”原则 ;指出新交通行政执法模式的实施应当是交通行政执法体制模式。

The paper analyzes reformation of the current model of law enforcement in traffic administration. We have come to the conclusion that reformation of the current model is essential, practicable and well justified. It educes the target and principle of reform and lays down theoretical foundation for the new model. The paper advances the principle of 'integration of balanced power and ensured administration' and claims that enforcement of new model should be the comprehensive enforcement of system model, operation model and team building model in traffic administration.
