On the Moral Character of the Penal Code

刑法调整的是对一个社会既定秩序和制度以及主流道德意识的严重不协调或对主流道德的严重反叛的行为 ,因此 ,刑法必须体现和维护一定的道德原则。首先 ,刑法要体现人性基础和人道主义关怀 ;其次 ,刑法要具有公正性 ;第三 ,刑法要讲求节俭性。

The Penal Code should regulate the behaviours that violate the social fixed order and system, and the rebellions against or the serious inharmoniousness in the dominant ethics. Hence, the Penal Code must reflect and maintain certain moral principles, such as its base of humanity and humane solicitude, its impartiality and its frugality.
