关于完善保护私人财产法律制度的思考

On perfecting the law institution on protection for private property

党的十六大提出,"一切合法的劳动收入和合法的非劳动收入,都应该得到保护",并进一步明确要"完善保护私人财产的法律制度"。本文结合我国现行法律在关于保护私人财产的规定中存在的问题,分析了在全面建设小康社会的新世纪中完善保护私人财产法律制度的必要性及其现实意义,进而认为真正完善这一制度的关键是呼唤私人财产权的宪法庇护。

16th National Congress of the Communist Party of China has offered 'Perfecting the law institution on protection for private property.' Combining with the problems which current laws in our country have on protection for private property, the thesis analyzed the necessity and practical significance of perfecting the law institution in the new century, and came to the conclusion that the key to perfecting the law institution is to make constitution protect private property.
