评我国的婚姻可撤销制度

Comment on Our Country's Voidable Marriage System

我国新《婚姻法》中的婚姻可撤销制度 ,一方面填补了旧《婚姻法》的空白 ,加强了对受害者的保护 ,是婚姻法制建设中的一大进步 ;但另一方面 ,其许多具体的规定又或付阙如、或制约甚至抵消着该制度功能的正常发挥。因此 ,有必要深入检讨、评价该制度的是非得失 ,以有助于今后民法典立法机构对其进行调整和修订。

The voidable marriage system in our countrys new marriage Law,on one hand,fills in the vacancy of the old marriage law and strengthens the protection for the sufferers.So it has made big progress during the process of marriage legal construction;On the other hand,however,many concrete regulations among this system are still in a vacant seat or,restrict,or even offset the regular work of this systems function.Therefore,It is necessary to discuss thoroughly and evaluate this systems true and false,which will contribute to adjust and revise it for the Civil Code Legislative Institution.
