摘要
社会的变迁终究要导致法律的发展。合同法作为调整各类交易关系的法律 ,在对市场起着极大的支撑作用的同时 ,也随着市场经济的发展而不断演化和发展。自 2 0世纪以来 ,随着社会经济结构发生巨变、科学技术突飞猛进以及经济全球化 ,从形式主义走向实质主义、对合同自由的限制、进一步强化对消费者的保护、诚信原则成为合同法中的一项重要原则 ,合同法的国际化等成为当代合同法发展的新趋势。
Social change after all will lead to legal development. The contract law, as the law to adjust various trading relations, has a great support on the market. At the same time, it constantly changes and develops with the development of the market economy. Since the 20th century, the tremendous change of social economic structure, rapid progress of scientific technology and economic globalization has taken place. The limitation on the contract, the further enforcement on the protection of the consumer, the principle of honesty and trust has become an important principle in the contract law from formalism to materialism. The internationalization of the contract law has become the new tendency of the development of the contemporary contract law.
