Redefining the Connotation of Force Majeure of the Construction Project

不可抗力对建设工程项目的影响越来越明显,其时常导致纠纷出现,甚至致使项目失败。通过文献研究和法律法规文件对比,总结出现建设工程项目中现有不可抗力内涵定义的缺陷,在《合同法》和《建设工程工程量清单计价规范》(GB50500-2013)关于不可抗力内涵定义的基础上,分析了不可抗力内涵的构成要件及相关争议事件,对不可抗力内涵进行了重新界定。重新界定后的不可抗力可以更好的指导工程实践、减少纠纷。

Influences of force majeure on construction projects become more and more obvious, which lead to disputes arising frequently, even generated project failure. The research of literature and legal documents was maked, and the defects of the force majeure was sum up. This article analysis of the elements of force majeure connotation and related controversies on the basis of the 'Contract Law' and 'Bill of Quantities construction specifications'(GB50500-2013), and redefine the connotation of force majeure. The redefined force majeure can guide the engineering practice, and reduce disputes more effective.
