法治视野下的农村计划生育问题——兼论《人口与计划生育法》的意义

The Birth Control in the Countryside in the View of Law ——The Meaning of the Law of Population and Birth Control

从法治的视角来看,农村计划生育中的问题是一个因法制不健全而引起的农民不依法实行计划生育和政府不依法行政的问题,它阻碍了农村的法治进程。《人口与计划生育法》填补了我国专门的计划生育法律的空白,对我国农村计划生育工作具有重大意义。今后的工作中应严格依法办事,提高执法水平,加强法律监督,培植法律信仰,并实行农村社会保障的法制化。

Abstract:In the view of law,the rural birth control problem is the one that the distemperedness of the legal system leads to the peasants' nonperformance of the birth control policy and the government's nonperformance of its administration which are both regulated by law. The problem holds back the process of rural nomocracy. The law of population and birth control supplies the gap of the specialized law of birth control in China and bears great meaning to the rural birth control project. In the future, the administration must be strictly lawful,and the execution of the law must be improved,the monitor of law must be strengthened,the belief of the law should be cultivated,and the nomocracy of the rural social security must be performed.
