惩罚性赔偿制度的出现和发展有其深厚的理论根基和时代背景 ,在侵权法中 ,它是各种基本功能相互间不断矛盾碰撞和协调发展的必然产物。本文以侵权法基本功能的演变为楔入点 ,着重在这一大背景下分析适用惩罚性赔偿制度的重要性 。

The appearance and development of punitive damages have their deep theoretical root and reflect the needs of times. In law of torts, punitive damages is the natural result of the interactions of the fundamental functions of torts. This article, from the angle of function evolvement of law of torts, argues the importance of the application of punitive damages in tort law, and brings forward some legal suggestions to the improvement of punitive damages in our country with reference to the experience of other countries.
