由于现行的道路交通事故处理工作中 ,所依据的法律法规滞后于时代发展 ;现行法律法规中 ,某些条文的不明确性及不易操作性 ,导致在道路交通事故处理工作中 ,事故处理人员往往只能依靠自己的理解来对条文进行运用。笔者就实际道路交通事故处理工作中易引起分歧的几个问题进行探讨。 1 在道路交通事故现场勘查中的几个问题 ;2 在道路交通事故责任认定中的几个问题 ;3 关于道路交通事故的行政处罚 ;4 关于道路交通事故损害赔偿的调解。

Staff using regulations in handling traffic accidents usually depend on their own understanding of regulations, because some regulations concerned are too vague to use them and lag behind the times. The author will deal with the following issues in the field: the investigation of traffic accidents; identification of accidents; executive punishment; mediation of claims for damage.
