人工智能的迅速发展给人类社会带来风险以及社会结构的变化是既定的,而社会结构的变化必将导致法律形态的变化。面对结果不可预测的人工智能,传统的嗣后规制性法律制度已不能有效实现其目的。因此,人工智能的未来法律制度研究须透过现象洞悉本质,认清和回应新的智能社会发展需求,由回应性法律精神融入并改善传统法律运行机制,为达成目的本身而强化规制性裁量权。特别要认清人工智能的不透明、不可溯,以及不可预测等本质特征可能在目标设定、数据读取,以及制度运行等三个方面引发的巨大风险,强化灵活回应人工智能社会变化的行政机构的规制权利和管理机制。

The rapid development of artificial intelligence brings risks to human society and changes in social structure,and changes in social structure will inevitably lead to changes in legal form.In the face of unpredictable artificial intelligence,the traditional post-regulatory legal system can no longer effectively achieve its purpose.Therefore,the future legal system research of artificial intelligence should understand the essence through the phenomenon,recognize and respond to the new intelligent social development needs,integrate and improve the traditional legal operation mechanism by the responsive legal spirit,and strengthen the regulatory discretion for achieving the purpose itself.In particular,it is necessary to recognize the opaque,irreversible,and unpredictable nature of artificial intelligence,which may cause huge risks in the fields of target setting,data reading,and system operation.It is necessary to strengthen the rights and mechanisms of regulation of administrative agencies that respond flexibly to intelligent social changes.
