完善证券民事责任制度的法律思考

On the Law Reflection of Perfecting Securities Civil Responsibility system

证券法中民事责任制度存在严重缺陷,其中对内幕交易、操纵市场、欺诈客户等严重损害中小投资者利益的违法行为的法律责任中,主要是刑事的和行政的责任。使受到损害的投资者得不到充分的法律救助。为了维护证券市场的三公原则,保障数千万投资者的切身利益,一方面应当尽快完善证券立法,另一方面法院的审判工作也应积极主动地介入证券纠纷案件的民事审判。

The serious shortcomings exists in civil responsibility system of securities law,in chich the deal from behind the scenes,manipulation market,cheat customers and other illegal actinties which infringes upon the middle and small investors' interest.which mainly bears the criminal and civil responsibility.The damaged investors don't get law succour.To safeguard the principles of the fair,open,just and ensure the investors' interest,we should perfect securities legislation as quickly as possible and the court should actively intervene the civil trial of securities depute case,too.
