摘要
依据我国法律法规 (宪法、水法 )中“水流”/水资源属于国家所有的规定 ,国家将承担水管理与保护职责。目前 ,政府机构的水管理职责被分配在几个国务院部委内 ,形成了“九龙管水”局面 ,多部门多重管理造成部门间的职能交叉与重叠 ,各部门的政策效力在分歧与冲突中相互削弱 ,是水环境不断恶化的重要原因。但是 ,由于水管理的复杂性与水资源的多重价值与稀缺性 ,水管理不可能完全实现由唯一部门负责进行全权管理 ,而必须实现多部门的协作管理 ,提高管理效率 ,为此 ,必须强化水环境的统一协调管理 ,加强流域管理、规划职能 ,剥离水环境管理权与监督权 。
Water resources are one of basic natural resourc es and one of the strategic economic resources. According to Chinese laws (such as the Constitution and Water Law), water flow or water is the national property , and the state has the responsibilities to administer and protect it. At presen t, the function of water administration is divided into several ministries under the State Council. The situation is called “nine dragons administer water”. The overlaps and interactions among the several ministries cause easily the con flicts or dissensions of their policies and strategies. Thus, the administratio n efficiency is lowered, and the situation of water environment is getting worse . In the paper, the problems of water administration among the related ministrie s, especially between the Ministry of Water and the Sate Environment Protection Agency are analyzed. Besides, the relevant countermeasures are advanced: to str engthen the unified and coordinated water administration; to strengthen the func tions of watershed management and planning; to separate the managing power with the monitoring power owned by one department; and to ensure the cooperatio n obligation among the related water departments.
