摘要
自白任意性规则是指在刑事案件中,只有基于被追诉人自由意志而作出的自白,才具有证据能力;缺乏任意性或具有非任意性怀疑的自白,不具可采性。以自白具有任意性作为取得证据能力的要件,现在已经为英美法系及大陆法系国家所共认。我国应确立自白的任意性规则,以进一步实现我国诉讼的民主化。
The free and voluntary rule of confession reveals that in criminal procedure, confession has the credibility only if it is derived from the suspect or defendant who is in a mental freedom position. Otherwise the confession is inadmissible. Free and voluntary confession is the legal condition of credibility in evidence and has been common understanding accepted by two genealogies of law. The free and voluntary rule of confession should be established to further implement the democratization of criminal procedure.
