天人合一境界中的中华法系之美

The Beauty of Chinese Legal System in the Realm of Tian-Ren-He-Yi(the Unit of Heaven-and-Human)

文章认为老子的法律观和审美观有着密切的关联 ,老子理想中的法律极有审美意义。进一步讲 ,整个中华法系都具有这一特征 ,这主要是由中国传统世界观造成的。古代中国基本的的宇宙图式是天人合一 ,这一图式又是一个审美境界 ,富于审美意义。此一特征广泛而深刻地影响了古中国法律 。

This article holds that there's a close interrelating relationship between Laozi's view of law and that of beauty. Laozi's ideal law is of great aesthetic value. Deeply speaking, the whole Chinese Legal System also has such a characteristic. That's mainly brought by our traditional view of world. The basic universe pattern of ancient China is Tian-Ren-He-Yi (the Unit of Heaven-and-Human). This pattern is also an aesthetic realm, aesthetically meaningful. That impacted broadly and profoundly on ancient Chinese Legal System, which made Chinese Legal System an aesthetic one, too.
