共同犯罪的实行过限是刑法共犯理论中的难点问题之一 ,学界从实行犯、组织犯、教唆犯、帮助犯等不同情形进行把握 ,明确了界定实行过限的一般标准。但在司法实践中 ,对转化犯、想象竞合犯、结果加重犯的实行过限问题尚有争议 。

It is a problem to determine the act of the excessive perptrators in the theory of criminal law.To dertermine an act of excessive perpetrators,academic circles have set up the common standard by deciding executors,organizors and accessories,but it is still a problem to deal with transformed ofˉfense,imaginative joiner of offense and aggregated consequentid offense.This paper does some reˉsearch on this.
