刑事附带民事诉讼的赔偿范围是受害人因犯罪分子的行为造成的物质损失,这种物质损失既包括直接损失,也包括一定范围的间接损失。间接损失的赔偿范围必须符合法定的条件。精神损害的损失原则上不能列入刑事附带民事诉讼的赔偿范围中,但被害人因犯罪行为造成容貌、肢体等残损导致婚姻、生活、就业等困难而遭受精神痛苦的可采取变通办法进行处理。

Range of compensation in the criminal lawsuit with civil claims covers the material losses on the part of the victim incurred from the criminal act,including the direct losses,and in some cases,the indirect losses as well.The range of compensation for the indirect losses thus incurred,however,is strictly defined by law.Generally,the losses of mental injuries are not covered in the criminal procedure with civil claims,but some flexible or alternative compensations are deliberated in justice to such serious mental injuries as resulting in difficulty in martial and daily life and employment,which may arise from the physical injuries done by the criminal.
