我国著作权合理使用制度设计上的问题及其重构

The Problems in System Design of Rational Use of Copyright in China and Its Reconstruction

当今世界,随着信息技术的快速发展,合理使用制度逐渐成为著作权法领域内的一项重要的制度,被各国著作权立法所确立。它的内涵外延的很多内容已成为学界研究的重点问题,具有较高的研究价值。我国在借鉴其他国家著作权立法的基础上,建立了具有我国特色的合理使用制度。但我国合理使用制度设计、运行等很多方面存在诸多不足,无法应对新时期下社会快速发展带来的新挑战和新问题。需要在认真分析此项制度在我国建立上存在的问题基础上,综合国内外先进经验予以解决。

Nowadays,with the rapid development of information technology,fair using system of copyright law has become an important system,which is determined by laws in different countries. Its connotation and extension has become the focus of academic study with high research value. In our country,based on the copyright legislation in other countries,we set up the fair using system with Chinese characteristics. But the design,operation and many other aspects of rational use of the system have many inadequacies,unable to cope with the new era under the rapid development of society which brings new challenges and new problems. With a careful analysis of this system in our country on the basis of the existing problems,the problems could be solved with integrated domestic and foreign advanced experience.
