摘要
审判实践中在如何界定离婚损害赔偿的主体范围、构成要件及忠实原则对离婚损害赔偿的实体法意义上的渗透等方面争议颇多。本文试图从理论与实践的结合上对这几个方面问题进行分析,并对社会生活中的具体问题提出自己的观点,以期为离婚纠纷的无过错方提供一种理性支持。
At present, there exist various arguments in deciding subjects, components of divorce compensation and infiltration of loyalty rule into compensation, etc. Therefore, the essay, combining theory with practice, attempts to make an analysis of the above - mentioned problems and reveals the author' s own viewpoints concerning the specific issues in real social life, hoping to provide some rational support and help for the side without fault in matrimonial disputes.
