试论《学生伤害事故处理办法》

On the Handling Measures towards the Accidents of doing an Injury to the students

学生人身安全是社会各界普遍关注的热点问题,近年来,由于有关学生人身伤害事故处理缺少具体法律规范,给其妥善处理带来很大难处,更影响到素质教育的深入发展。教育部经过多年调查研究及借鉴有关经验于2002年6月25日颁布了《学生伤害事故处理办法》,该办法具有较强的针对性、实用性和可操作性。本文从学生伤害事故的范畴;学生伤害事故责任的归属和认定;学生伤害事故损害的赔偿三个方面予以论述。

The students,personal security is an important problem which attracts many people's attention in our society. In recent years,owing to lack of the specific law regulation this causes the difficulty in handling the accidents and influences the further development of qualities education. Ministry of Education published the handling measures on June 25,2002 according to the many years' swrvey an research. The measures are practical and feasible. The article illustrates the measures from three respects.
