随着社会的发展 ,发送短信息已经成为人们信息交流的主要方式。但是 ,像一切新生事物一样 ,短信在使用过程中也出现了一些不良倾向 ,在不久前的“非典型肺炎”事件和“8858手机公益短信”活动中 ,短信都扮演了不甚光彩的角色 ,给人们的生活带来了很大的困扰。本文从安宁权的角度出发 ,结合我国立法现状 ,以期对“短信骚扰”问题做出法律规制。

Along with the society's development, sending out messages has already become the main means for people to communicate with each other. But like all the new things, messages also appear some bad tendencies. Messages have played an unpleasant role during the sars affair and 8858 cellular phones publicspirited messages affair, bringing people to big harassment. In terms of quiet and peaceful right, together with the our country present condition of legislation, it is wished to draw up the regulations for the message disturbance problem.
