Combination of Rule by Law and Rule by Morals: the Inevitable Trend of Historic Development

我国古代对性善与性恶问题的争论,曾在某些方面对我国的立法与司法产生过一定的影响。道德是法律产生的基础,法律又为道德教育提供制度保障。依法治国和以德治国是一个古老的但又是一个与时俱进的话题,二者之间相辅相成,相互联系,相互促进。法治与德治并举是历史发展的必然趋势。

The controversy between kindness by nature and evilness by nature in ancient China, in some aspects, has produced some civilizing influence on China抯 legislation and execution of law. Morality is the basis of the production of law, and meanwhile law may offer moral education systematical security. Rule by Law and morals is not only on old topic but also everlasting topic keeping pace with the times, and they are mutually complementary, interconnected and interactive. The combination of rule by law and rule by morals is the inevitable tread of historic development.
