The Value of Morality in the Society with Rule of Law

法律起源于道德。因此,现代立法都非常重视法律必须反映社会最基本的道德要求,即最具普遍接受性的道德层次。法律的滞后性特点,使法律无法完全反映社会基本道德要求,但这种矛盾却可以进一步推动法律发展。在司法实践中,法官“自由裁量权”在有法律明确规定或无明确规定的情况下,都存在着不得不利用社会基本道德原则案例,如何防范任意性或随意性的司法实践道德原则运用,需进一步探讨完善。

Law stems from morality.So,in present-day legislation ,special attention is paid to the fact that law must reflect the most basic requirements of social morality.Being lagged,law is impossible to completely reflect the basic requirements of social morality .However,such a contradiction can further promote the development of law.In the practice of administration of law,it is essential to seek more effective measures to prevent abusing the basic principles of social morality.
