摘要
单位行贿罪的刑罚和行贿罪的刑罚之间的关系值得探讨。本文运用线性回归方法,通过对603个单位被告的单位罚金数额和250个个人被告的个人罚金数额的显著影响因素和基准刑进行对比实证研究,得出结论:在行贿数额大于20万元以上时,单位行贿罪中单位罚金数额的基准刑明显高于行贿罪中个人罚金数额的基准刑;责任人罚金数额可以参照个人罚金数额的基准刑进行设置。另外,通过对510个单位责任人被告的责任人自由刑刑期和250个个人被告的个人自由刑刑期的显著影响因素和基准刑进行对比实证研究,得出结论:单位行贿罪中责任人自由刑刑期的基准刑明显低于行贿罪中个人自由刑刑期基准刑;协调责任人自由刑的基准刑和个人自由刑的基准刑之间的差距,是避免个人以单位名义行贿而逃避罪责的关键。总之,为了单位行贿罪和行贿罪之间的刑罚均衡,应当统一单位行贿罪和行贿罪内部刑罚的基准刑;协调责任人罚金刑、自由刑和个人罚金刑、自由刑的基准刑;分离单位和责任人刑事责任,提高单位罚金刑。
It is valuable to compare the penalty between the Unit Bribery and the Personal Bribery. By analyzing the Fine penalty of 603 Unit cases of the Unit Bribery and 250 personal cases of the Personal Bribery, we found that the Benchmark Line for the Unit Fine Penalty is higher than the one for the Personal Fine Penalty when the amount of bribe is above 200,000 RMB;the Unit Responsible Person Fine Penalty should be stipulated according to the Personal Fine Penalty. Moreover, by analyzing the Freedom Penalty of 510 Unit Responsible Person cases of the Unit Bribery and 250 personal cases of the Personal Bribery,we found that the Benchmark Line for the Unit Responsible Person Freedom Penalty is lower than the one for the Personal Freedom Penalty, which is the legal loophole for certain person to beat the rap. In summary,to keep the Sentencing Balance of the Unit Bribery and the Personal Bribery, the Benchmark Line of the Unit Responsible Person Penalty and the Personal Penalty should be unified;the criminal responsibility for the Unit Responsible Person should be peeled from the criminal responsibility of the Unit Crime.
