基于协同创新的高技术产业知识产权联盟组织与行为模式研究

On the Research of the Organization and Behavior Mode of the Intellectual Property Alliance of the High Technology Industry Based on the Collaborative Innovation

高技术产业是技术密集性产业领域,组建产业联盟、开展协同创新,是我国高技术产业实现突破发展的重要模式之一。协同创新会促进知识流外溢,形成产业发展聚合效应,这离不开系统化、高层级的知识产权战略联盟组织形式的保障。联盟内知识产权共享与许可规则,可以采取自动许可(Automatic Licensing)、专利池(Patent Pool)等方式,并向创新参与主体多元化、创新行为过程标准化方向迈进;联盟应搭建知识产权公共服务平台和增值服务平台,通过信息挖掘、特色定制和权益增值等活动,实现对创新成果的聚合、优化与抬升功能;高技术产业协同创新最终成熟的组织形式,应当是'强知识产权规约'之下的'创新社区',是融合技术创新输出方、服务连接体以及终端用户的有机整体。

The high technology industry is technology-intensive. It is one of the important modes for Chinese high-tech industry achieving a real breakthrough development. The collaborative innovation can promote knowledge spillover and form industrial development convergence effect. The systematic and high-level organization form of intellectual property strategic alliance can not be neglected therein. Intellectual property rights sharing and licensing rules within the alliance can be implemented by means of the automatic licensing and Patent Pool,etc. The ultimate goal of the collective alliance is to the direction of diversification of innovative participants and standardization of innovative behavior process. The collective alliance should establish public service platform and value-added service platform for intellectual property rights inside. The mature organization mode of synergistic innovation in high-tech industries would be a ' innovation community'under the' strong intellectual property rights statute ', which is the organic integration of technology innovation exporters,service connectors and end users.
