网络游戏直播画面的内容包括游戏素材、玩家的智力投入、玩家添加的个性化内容和玩家与观众的互动内容。游戏自由度会影响网络游戏直播画面的定性,游戏自由度非常高和比较高的网络游戏直播画面构成类电影作品,玩家有可能成为游戏'剧本'的'表演者';而游戏自由度非常低的网络游戏直播画面只能作为录像制品。游戏直播模式会影响游戏直播画面的著作权归属,在'大型电竞赛模式'和'转播+独立解说模式'下,游戏直播画面的著作权归属于获得游戏开发者授权的赛事主办方;而在'自玩自说模式'下,游戏直播画面的著作权归玩家享有。
The contents of online games live pictures include game materials,intellectual inputs of the player,personalized contents added by the player,and interactive contents between the player and the audience.The degree of freedom of the game will affect the copyrightable issues of game live pictures,the live pictures of very high degree freedom and relatively high degree freedom game constitutes a work similar to cinematography,and the player may become a 'performer'of the game 'script',but the live pictures of very low degree freedom game can only be viewed as a video product.The mode of organizing game live will affect the copyright ownership of those pictures.The ownership of game live pictures under the'E-sports games mode'and'retransmission + independent comment mode'is attributed to the event organizer authorized by the game developer;and under the'self-playing and self-commenting mode',the copyright is owned by the player.
