摘要
我国《职业教育法》颁布已有20年,并取得了一定成效。但由于社会经济结构的调整,该法已不能很好地诠释法律关系,必须重新修订。自2008年进入修订议程后至今已有8年,由于种种原因,新的职业教育法迟迟难以推出。因而,新的职业教育法的出台已经成为一项非常紧迫且现实意义与历史意义并重的任务。反思修法进程,其种种争议背后的根本原因是没有超越原有理论框架。要想突破职业教育法修订困境,就应该探索新的理论视角,审视、解读实践问题,并提出法的进一步修订建议。
Vocational education law has been developed in the past 20 years.However,it cannot guide the legal relationships effectively with the transformation of social economic structure,so we must revise it. It is a very urgent task with realistic and historic significance in the process of education law revision. It had been put on the agenda since 2008,but due to complexities involved,there was no resolution in the past 8 years. The reason for this lies in the fact that it has not been able to transcend the original theoretical frame. Therefore,to break the dilemma of law revision,we should explore a new theory to examine and explain practical problems before making suggestions for the revision.
