摘要
"在家上学"渊源于学校义务教育的种种弊端,并诉求通过家庭教育方式给适龄儿童一种更适合其个性发展的义务教育,而合理不合法的现实窘境则阻碍了"在家上学"的有益探索,也不利于适龄儿童受教育权的保障。借鉴国际经验,建立一套具有可操作性的准入、服务、监督、评价和退出机制,是实现"在家上学"合法化的关键。唯有如此,"在家上学"方可成为学校义务教育的法定补充。
The issue of home schooling derives from the drawbacks of compulsory education in schools. Through home schooling,children of school age can have access to a more appropriate way of compulsory education,which is more suitable to children's personality development. However,in fact,the status quo of home schooling is reasonable but unlawful,which impedes its development and does harm to school-age children's right to education. The crux of the legalization of home schooling lies in creating a series of practical mechanisms of admittance,service,supervision,evaluation and exit. Only in this way can home schooling develop into a legal supplement of compulsory education in schools.
