摘要
在全球化的今天,劳务移民是一个世界各国都必须面对的普遍现象。在充分尊重移民权利的前提下进行有效管理并不是一件容易的事情。本文在中国于2013年出台了新的《出境入境管理法》和即将修订《外国人来华就业管理条例》之际,全面梳理和分析保护移徙工人权利的相关公约、案例和解释性法律文件,厘清移徙工人权利保护的国际法标准,希望藉此为我国相关立法提供参考。
Along with the globalization,labor migration has become a universal phenomenon that every country has to face. It is not easy to manage this phenomenon effectively against the background that rights of migrant workers are fully respected. With the Exit and Entry Administration Lawpromulgated in 2013 and the Regulations on Administration of the Entry and Exit of Foreigners to be amended,this paper intends to clarify the international standards on safeguard of the rights of migrant workers by conducting a thorough study and analysis of relevant conventions,cases and jurisprudence,therefore serving as a reference for China on relevant legislation.
