摘要
气候变化已经成为当代人类社会面临的最大的和最为紧迫的人权危机之一,由于气候变化对于不同群体和发展程度不同的国家影响不同,所以公平问题或者是"气候正义"是人权语境下国际社会在应对气候变化问题时所不能回避的关键问题。当今渐渐出现了把气候变化与人权放在一起考量的潮流,希望能够通过推动这两大体系的互融来实现应对气候变化和保护人权的双赢。如何从国际法角度来保障气候变化的人权正义以及如何使现有的人权法体系体现对气候变化引发的人权危机的充分关注,是一个亟待解决的难题。本文在深入分析气候变化与人权的辩证关系的基础上,探讨了如何推动新的联合国气候变化协议的"人权化"以及推进现有人权法体系的"绿色化"。
Climate Change hasbecome the most serious human rights threat facing the mankind.Given that the least developed nations and the more vulnerable groups tend to be more sensitive to the harms of climate change,the question of equality,or climate change justice,is an important issue that must be dealt with in fighting against climate change.Against this background,there is an emerging trend to adopt both human rights and climate change perspectives to tackle the climate change-induced human rights crisis.It is hoped that this dualperspective approach may lead to a win-win result by both protecting human rights and providing innovative ways to tackle climate change.Although more and more attention is being paid to the human rights dimension of climate change,little is known as to how to achieve climate change justice.With this question to answer,this article investigates the relationship between human rights and climate change.And based on the findings,it further explores how to 'green' the existing human rights legal framework and how to incorporate the human rights language in the upcoming UN climate change agreement.
