The Background and Core Conception of the Convention on the Rights of Persons with Disabilities: A Review

残疾人权利公约》于2008年5月3日正式生效。回顾该公约起草的社会背景,对其基本理念和核心条款进行再解读,对于在我国国内法中更全面地落实该公约,推动我国残疾人权利保障事业的进步,具有积极意义。《残疾人权利公约》的序言明确确认了残疾人权利的价值及其基础,确立了残疾人权利保障的指导思想和基本原则。我国主动按照公约要求,通过立法、行政措施及其他适当措施积极履行公约;近年来通过加强对残疾人的法律援助、加强办理残疾人案件的司法责任等方式,不断积极推动对残疾人的司法保护。

The Convention on the Rights of Persons with Disabilities came into force on M ay 3,2008. Review ing the social background of the drafting of the Convention and reinterpreting its basic concepts and core provisions is of positive significance for the more comprehensive implementation of the Convention in China’ s domestic law and the advancement of the rights protection of disabled persons in China. The preamble of the Convention on the Rights of Persons w ith Disabilities clearly confirms the value and foundation of the rights of persons w ith disabilities and establishes the guiding ideology and basic principles for the protection of the rights of persons w ith disabilities. China has actively implemented the Convention through legislative,administrative measures and other appropriate measures in accordance w ith the requirements of the Convention. In recent years,it has actively promoted the judicial protection of disabled persons by strengthening legal aid for disabled persons and strengthening judicial responsibility for handling cases of disabled persons.
