Business and Human Rights Case Study of Korean Companies Operating Overseas: Challenges and a New National Action Plan

摘要 韩国的公司正在变得更加跨国化,它们日益面临在受冲突影响地区或管理薄弱地区严重侵犯人权的风险。因此,越来越多的人呼吁韩国企业在其全球业务中采取有效的人权尽职调查措施,以遵守2011年联合国工商业与人权指导原则。韩国的国家人权委员会尤其是处在韩国推动联合国这一指导原则的前沿。2016年7月,韩国国家人权委员会向韩国政府提交了一份正式建议,要求通过一项新的国家工商业与人权行动计划。鉴于这些发展动态,我们旨在通过一系列涉及韩国公司的案例研究,提出韩国政府加强其法律体系和能力的建议,以解决严重的企业侵犯人权问题。 As companies from the Republic of Korea are becoming more transnational,they are increasingly exposed to the risks of being involved in serious human rights abuses in conflict-affected areas or w eak governance zones.Therefore,there are increasing calls for Korean companies to exercise effective human rights due diligence measures in all of their global operations for compliance w ith the 2011 UN Guiding Principles on Business and Human Rights.The National Human Rights Commission in the Republic of Korea,in particular,has been at the forefront of promoting the UN Guiding Principles in Korea.M ore specifically,on July2016,the National Commission on Human Rights submitted a formal recommendation to the Korean government to adopt a new National Action Plan on Business and Human Rights.In light of these developments,this paper aims to present w ays in w hich the Korean government can strengthen its legal system and capacity to tackle serious corporate human rights abuses based on a series of case studies involving Korean companies.
