摘要
以合同法为准则 ,简介工程承发包双方之间的关系 ,阐述了施工企业在施工中的优先受偿权及相应的预防措施 。
Based on contract law the relationship between contractor and party issuing contract is introduced. The repayment priority and corresponding prevention measures in construction are elaborated. Author point out that implementation of contract law is the only way to solve the issues obstacle the development of building market.
