农村土地承包是实现土地所有权和使用权分离的有效途径。依法流转是土地使用权的本质特征,而流转的方式是有效实现流转的关键事项。本文就2003年3月1日实施的《土地承包法》中规定的用土地承包权入股投资的问题作了探讨,剖析了两种承包方式下土地承包权入股投资的异同点,以明晰立法本意,方便实践操作。

Rural land contract is an efficient way to separate servitude from land ownership. Circulation according to the law is the essential quality of land ownership, while the way of circulation is the key part to achieve efficient circulation. This article discusses the questions of investigation by using the right of land contract as shares stipulated in 'land contract law' carried out on Match 1, 2003 and analyses the differences and common points under two types of contracts of investigation by using the right of land contract so as to clearly define the meaning of the law and facilitate the operation in practice.
