在1990年代的市场经济大潮之下,中国法学界的权利观也在发生变化。不同于此前的权利观强调个体自主和法律下的自由,这个时期,权利开始同利益结合起来,利益成为界定权利的唯一尺度。这一以利益为核心的权利观的发展,导致了对权利主体的遗忘,也导致了权利的怀疑论的兴起,造成了1990年代权利理论深刻的内在危机。与此同时,这一权利理论的发展,也引发了权利理论研究者们的反思,相关理论研究者开始深入权利主体中,探究权利的来源,反思和批判权利等同于利益的观点,这一切都使1990年代的权利观念呈现比较丰富的内涵,也为新时期的权利理论的发展敞开了空间。
