摘要
在给出了意临作品的界定方法与标准的基础上研究了书画艺术临摹品中的意临作品创造性的界定与表现特征、意临作品创造性的判定、意临作品创造性的层次与意临时原作的合理使用等问题;在意临书画作品是否具有创造性深入分析基础上,得出了对于书画艺术临摹品是否具有著作权不能一概而论,意临作品具有创造性和一般具有著作权的结论。
This paper looks into the definition,characteristics,evaluation,structures,and reasonable application of the spiritually imitated work's creativity on the basis of its definition approach and criteria.It is concluded that unified principles should not be applied to evaluate the copyright of the painting and calligraphy copies and that creativity and general copyright should be placed upon these copies when it comes to the in-depth analyses of the creativity of the spiritually imitated works.
