重大误解若干问题研究

A Discussion about Several Issues Concerning "Significant Misunderstanding

民法重大误解制度中的误解概念、误解标准和撤销权是三个比较重要的问题 ,对这些问题的澄清与辨证 ,对重大误解存在的问题进行研究 ,具有重要的意义。关于误解概念 ,笔者比较了两大法系的误解观 ,阐述了我国的研究现状 ,并对误解概念作了论证。关于误解标准 ,笔者对传统标准提出疑义 ,指出了这些标准可能引发的混淆。关于撤销权 ,笔者则对撤销权人、撤销权行使的法律效果。

The essay makes a comparative study of the views of the two major schools of law science on the concept of misunderstanding; expounds the present condition of the study in China; advanced the author's own views on such questions as misunderstanding norm, power to rescind, and etc.
