挪用公款罪共犯研究

Research on Embezzlement Accomplice

挪用公款罪共犯分为单位内部人员之间相互勾结和内外勾结两种。挪用公款罪的共犯必须同时具备犯罪主体、客观方面、主观方面三个条件。挪用公款罪共犯的刑事责任应当采纳"参与额说",即追究共同挪用公款犯罪刑事责任的基准数额应是共同挪用的公款总和。

Embezzlement accomplice involves two types: embezzlers from the same unit in collusion with each other and people from inside collaborating with the outside. Embezzlement accomplice should have three conditions including crime subject, objective and subjective aspects. The criminal responsibility of embezzlement accomplice should be decided by adopting the theory of total sum involved. 
